The terms and conditions below apply to all services provided by Ally
McCullagh, The leadership Coach, to any individual or organisation. In these
terms (“the Terms”), Purchasing or booking any services from The Leadership Coach constitutes acceptance of the Terms. The Terms shall not be varied in any way whatsoever unless agreed in advance in writing between the parties.

“Fee” means the sum payable by you to us for the Services. ‘Services’ means
coaching services, leadership skills training and I.D. profiling (including but not
limited to individual one-to-one sessions, The Leadership Coach membership
and, I.D. consultations) as requested by you. ‘Session’ means a coaching
The ‘coach’ refers to Ally McCullagh. The ‘client’ refers to the person or
organization paying the fee for services. The ‘coachee’ refers to the
individual being coached by Ally McCullagh.
1.1 I agree to supply coaching services to you and you agree to pay the Fee
for the same subject to these Terms.
1.2 The exact date and time of my supply of the Services is agreed when you
book one of the session slots in the simply book me scheduling system, or both
parties confirm a date and time via email, telephone or in person.
1.4 No variation to these Terms shall be binding unless agreed in writing and
signed by both parties.
1.5 Coaching sessions will continue until terminated by the client or by mutual
agreement. The client acknowledges that he/she may terminate or
discontinue the coaching relationship at any time.
1.6 Coaching sessions are conducted over the phone, internet, or in person if

scheduled meetings as defined to the client by the coach.
2.1 Website rates are in NZ $ Coaching rates are exclusive of GST at 15%
Membership is inclusive of GST.
2.2 Private invoicing and bookings rates are exclusive of GST and issued
2.3 Payment is required within 30 days of invoice or unless otherwise agreed
upon by both parties.
2.4 The amount of the Fee shall be agreed in advance between the parties
when you select one of the Services. By selecting a specific Service, you are
agreeing to pay the Fee in full at booking or in
installments agreed in advance with Ally McCullagh.
2.5 If the client requires reporting services on the progress of the coachee
(highly recommended) this will be charged for as an additional fee to
3.1 Everything shared during coaching sessions is kept in the strictest of
confidence between the coach and the coachee or the coach and the

b) The coachee discusses something which places a legal or ethical
obligation on the coach to disclose.
3.2 In the case of reporting. The coachee agrees to general themes being
communicated to the client. Such as rate of progression, engagement level,
general discussion topics.
4. Objective and Responsibility:
4.1 The coaching objective is set in collaboration between the coachee, the
coach and the client, led by the client’s needs. The coach is responsible for
regularly verifying with the client and the coachee if the coaching discussion
is meeting the objective, or if the objective needs to change.
4.2 As your coach I undertake to be on time at the coaching location,
prepared for the session and focused to support you in achieving your
5. Length and Duration:
5.1 The sessions will be one hour in length.
5.2 Coaching progress, duration and number of sessions required depends on the individual client, their commitment to practice, motivation, level of
engagement and openness to change.
5.3 I will do my best as the coach to estimate future progress during the
reporting and coaching process.
6. Client responsibility and obligations:
6.1 It is the client’s responsibility to be prepared, punctual and focused for
coaching sessions to ensure the effectiveness of the coaching process.
6.2 Coaching is only effective if the client is ready and open to practice new
skills, spend time reflecting and completing agreed upon homework.
6.3 The coach reserves the right to suspend, or discontinue further coaching
sessions if a client is not committed to completing agreed action points
6.4 It is the coachee’s responsibility to communicate how effectively the
coaching session are meeting the needs of the coachee.
7. Cancellation Policy:
7.1 Please let me know 24 hours in advance if you need to cancel or reschedule an appointment.
7.2 Cancelling the booking more than 24 hours in advance, the client will be
eligible to a full refund or the option to reschedule the booking.
7.3 The client will be charged the full cost of the session if the booking is
cancelled on the same day. This is due to time spend preparing for the
session and not having enough notice to use the time profitably.
7.4 The full cost of the coaching session will be charged if no notice is given
7.5 In the event that a service is cancelled by the coach you have a right to
a full refund or reschedule of your session to new a suitable date at no
8.1 I realise that sometimes a sudden illness of you or dependants can
prevent you from giving 24 hours notice. In this instance you will only be
charged 50% of session fee.
9.1 I appreciate being late at times is outside of your control. Please be
aware if a client is booked in after you your session will finish on time in order to accommodate the next client.
8. Refunds Policy:
8.1 If you choose to cancel your session with more than 24 hours notice you
will be eligible for a full refund of paid session fees. In this instance the client
should notify the coach in writing.
8.2 A full refund or additional session will be given if a client is unhappy with
any part of The Leadership Coach services. In this instance you should notify
the coach within 48 hours of having had the session with your reasons for
dissatisfaction. I pride myself very highly on my work and if you do not feel
that you have got value, I would appreciate being made aware of it.
9. Limitation of liability:
9.1 The coach shall not be liable to you (excluding for personal injury or
death, fraud, or willful default) for any loss or damage (including without
limitation, any direct, indirect, punitive or consequential loss or damages, or
any loss of income, profits, goodwill, data, contracts, and whether in tort
(including without limitation negligence, contract or otherwise) that may
result in connection with the Services.
9.2 My liability to you shall at all times be limited to the amount paid, if any,
by you for the Services.
